Successfully Securing a Student Visa After a Previous Refusal on Genuineness Grounds

Electronic Visa Waivers
October 6, 2026

Our client approached us after previously being refused an Innovator Founder visa, despite having received endorsement from an approved endorsing body.

The application had been refused because the Home Office raised concerns about the applicant’s genuineness as an Innovator Founder. This arose from their previous time in the UK on the Start-up route, during which they had not completed the required periodic check-ins with their endorsing body.

There were important circumstances behind this. The client had been dealing with significant family commitments in the US involving a seriously unwell family member, which affected their ability to meet their obligations.

The client subsequently decided to pursue a Master’s degree in the UK but was concerned that the previous refusal, particularly the concerns raised about their genuineness, could affect their Student visa application.

We prepared detailed legal representations addressing the previous refusal and, in particular, explaining the compassionate circumstances surrounding the client’s failure to maintain contact with their endorsing body. We also acknowledged the client’s own responsibility for what had happened and provided context to demonstrate why the previous circumstances should not undermine their current plans to study in the UK.

The Student visa application was successfully approved.

Our client can now move forward with their Master’s degree in the UK and continue with their plans for the future.

This case demonstrates the importance of addressing a previous refusal openly and providing the Home Office with the full context behind what happened, particularly where there are genuine and compelling circumstances that need to be taken into account.

A previous visa refusal does not necessarily mean that your UK immigration options have come to an end.

Much will depend on the reason for the refusal, the circumstances surrounding it and the immigration route you are now looking to pursue. In some cases, there may be another route available or a way to address the concerns raised in the previous application. The key is understanding why the application was refused and whether those issues can be properly addressed before making the next application.

If you have previously been refused a UK visa and are unsure what that means for your next steps, get in touch and we can take a look at your circumstances and explain what options may be available.
